Terms of Service
Last updated 27 October 2026
These terms apply between Wyndham Knox Limited, a New Zealand company trading as Tourviewer ("Tourviewer", "we", "us"), and the business that creates an account ("you", the "customer"). By creating an account or using Tourviewer you agree to these terms. Contact us at will@mytourviewer.com.
1. The service
Tourviewer lets tour operators build photo-and-caption tours and show them live, slide by slide, on guests' own phones during a tour, in the guest's chosen language. Guests join with a code or QR code and do not need an account.
2. Accounts
You must give accurate details and keep your login secure. You are responsible for everything done under your company account, including by guides and staff you invite. Each account must be used by the person it was created for.
3. Plans and payment
- Free: no payment. 1 tour, up to 15 guests per session and up to 5 guides.
- Operator: NZ$69/month. 10 tours, up to 50 guests per session and up to 15 guides.
- Fleet: NZ$299/month. Unlimited tours, up to 100 guests per session and up to 100 guides, plus priority support and setup help.
"Guides" means guide, driver and other staff accounts in your company, including pending invitations. Paid prices are in New Zealand dollars and include GST. They are billed monthly in advance through our payment provider, Stripe. You can cancel at any time; cancellation takes effect at the end of the current billing period. See our Refund Policy.
Founding-operator rate. Eligible early customers who are offered this rate pay NZ$49/month (incl. GST) for as long as their subscription stays active. If the subscription ends, the rate ends.
We may change prices or plan limits by giving you at least 30 days' notice by email. Changes apply from your next billing period after the notice ends. If you move to a plan with lower limits, your existing tours are kept, but some may become read-only.
4. Business use
Tourviewer is supplied to businesses only. You confirm that you are acquiring the service for the purposes of a business. To the extent permitted by law:
- the Consumer Guarantees Act 1993 does not apply, because you are acquiring the service in trade (section 43 of that Act); and
- we both agree that sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply (section 5D of that Act). We both agree it is fair and reasonable to do so, as we are both in trade.
5. Tips
If you switch on tipping, guests see a "Tip your guide" button that opens your own payment link, such as a Stripe Payment Link or PayPal.me. Tourviewer does not receive, hold or distribute tip money. We are not responsible for those payments, for the payment provider, or for how you share tips with your guides.
6. Acceptable use
You agree that you, your staff and your guests will not use Tourviewer to:
- upload or show unlawful, defamatory, hateful, obscene or otherwise offensive content;
- upload images or text you don't have the rights to use;
- upload malware, or attack, overload or interfere with the service;
- scrape, copy or resell the service, or access it other than through its normal interface;
- harass or abuse anyone, or break any law.
We may remove content or suspend accounts that break these rules, with or without notice.
7. Your content
You keep ownership of the photos, text and other content you upload. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, translate and display that content, only as needed to run the service for you. You confirm you have the rights to give us this licence.
8. Availability
The service is provided "as is" and "as available". We work to keep it running, but we don't guarantee any level of uptime or that it will be error-free. Mobile coverage and guests' devices are outside our control.
9. Liability
To the extent permitted by law, our total liability to you for all claims is limited to the fees you paid us in the 12 months before the claim, or NZ$100 if you were on the Free plan. We are not liable for indirect or consequential loss, including loss of profit, revenue, data, business or goodwill.
10. Indemnity
You indemnify us against claims, losses and costs arising from your content, or from your or your staff's breach of these terms.
11. Termination
You can stop using Tourviewer and cancel at any time. We may suspend or end your account if you seriously or repeatedly breach these terms or don't pay, or by giving you 30 days' notice. After termination we may delete your content in line with our Privacy Policy.
12. Changes to these terms
We may update these terms. We'll tell you about material changes by email or in the app at least 30 days before they take effect. If you keep using the service after that, you accept the new terms.
13. Governing law
New Zealand law governs these terms. The courts of New Zealand have exclusive jurisdiction.
